INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6) I ([XXX]) AM FILING A COMPLAINT ON BEHALF OF MY MOM ([XXX]) WHO OWNS THE 2007 BMW 530I IN QUESTION (VIN #: [XXX]). ENGLISH IS NOT HER PRIMARY LANGUAGE. ACCORDING TO MY MOMїS ACCOUNT, ON 11/10/2009 SHE PULLED HER CAR INTO THE DRIVEWAY AND WAITED FOR THE GARAGE DOOR TO OPEN. BUT AS SHE LET GO OF THE BRAKE PEDAL, THE CAR STARTED TO ACCELERATE VERY QUICKLY WITHOUT HER INTENTION. SHE TRIED TO APPLY THE BRAKES, BUT THE CARїS MOTOR WAS JUST TOO POWERFUL TO PREVENT THE CAR FROM CONTINUING TO ACCELERATE INTO AND ALMOST THROUGH THE GARAGE WALL. WE REPORTED TO BMW OF NORTH AMERICA AND ASKED THEM AT THE TIME WEATHER UNINTENTIONAL ACCELERATION AND OR SOME PROBLEM WITH THE ELECTRONICS GOVERNING THE CARїS ACCELERATOR WAS RESPONSIBLE FOR THE ACCIDENT AND THEY TOOK THE VEHICLE, TESTED IT, AND CONCLUDED THAT THE VEHICLEїS DIAGNOSIS RETURNED NO SUCH ERROR. I EXPLAINED TO THEM THAT WITH DRIVE BY WIRE TECHNOLOGY AND ALL THE ELECTRONICS GOVERNING THE CAR, THERE COULD HAVE BEEN SOME SOFT OF A SHORT-CIRCUITING OR PROBLEMS WITH IT. THEY TOLD US THAT THERE WAS NOTHING THEY COULD FIND WRONG WITH THE VEHICLE. WE WERE TOLD THAT IT WAS MY MOMїS FAULT AND THAT SHE MIGHT HAVE MISTAKENLY PUSHED THE WRONG PEDAL, WHICH MY MOM VIVIDLY REMEMBERS SHE DID NOT BECAUSE ONCE THE CAR ACCELERATED SHE QUICKLY TRY TO PUSH THE BRAKES, WHICH WERE OVERPOWERED BY THE CAR. OUR INSURANCE HAD TO PICK UP THE BILL. I UNDERSTAND THAT BMW WOULD NOT BE WILLING TO ADMIT FAULT IMMEDIATELY AND IT IS ALSO POSSIBLE THAT THE DIAGNOSIS SYSTEM CANNOT DETECT SUCH PROBLEMS. ON FEB 8/9, 2011,MY WIFE WAS COMING BACK FROM WORK IN 2004 BMW 530 WHEN SHE SMELL SOMETHING BURNING AND A TINGED ON HER LEG, SHE GOT OUT FROM THE CAR AND SAW A SMOKE AND A BURNING MARK ON THE DRIVER SEAT. I CALLED THE BMW ON 2-10-2011, AND TALKED TO THE REP ABOUT THE SAFETY ISSUE. THE REP TOLD ME THAT I WILL CALL BACK IN 3/5 DAYS BUT CALLED ME BACK AFTER 4 WEEK AND REFUSED TO ADDRESS THE SITUATION.I TOLD THE REP THAT BMW IS A REPUTABLE COMPANY, AND THEY SHOULD FIX IT, AND I WILL REPORT TO THE SAFETY DEPT AS SOMEBODY COULD GET HURT. *TR
